FARROW & POLE LTD - TERMS & CONDITIONS

1. Farrow & Pole Ltd will provide all customers with a written quotation / estimate, which by all means possible will include sufficient detail for the completion of the works. Further clarification can be required upon request. Additional / Extra works must be requested in writing in the form of an email or text message.

2. Additional works may or may not be accepted, whereby the additional works are accepted an updated quote will be provided to the client which must be agreed as stated earlier.

3. A ‘contract’ with Farrow & Pole Ltd is an agreement by the client to have work undertaken based on a written quotation. The contract will be submitted directly to the client wherever possible, should the client use a project manager / architect to act on their behalf any the client will be liable for any works agreed by the project manager / architect. Once a quotation has been accepted and the client has paid their deposit, then a contract has been entered into and these terms will come into effect.

4. Quotes are valid for three months from the date on the quote.

5. COOLING OFF PERIOD

Once the client has entered into a contract with Farrow & Pole Ltd, by paying their deposit, they have a 14 day cooling off period should they wish to cancel the contract. If the work commences before the 14 day cooling off period the cooling period is considered exhausted. The client can cancel their contract within 14 days by email to Farrow & Pole Ltd.

6. MATERIALS

All used materials on-site remain the property of Farrow & Pole Ltd and will be disposed of accordingly, any original or removed materials will remain the property of the client. Additional quotes shall be provided should the client wish to have their materials disposed of.

7. DISRUPTION

Farrow & Pole Ltd will aim to provide minimum disruption to the client and the client will allow work to be carried out efficiently by the contractor.

8. SITE ACCESS

Free access is required for delivery of building materials, plant, machinery, skips etc.

9. PLANNING PERMISSIONIt is the customer’s responsibility to arrange planning permission, building control and any utility changes. Farrow & Pole Ltd may be able to assist the client with planning permission, this will be subject to its own quotation. If planning permission is required for the work, Farrow & Pole Ltd may request to see proof that this has been agreed prior to beginning work.

10. DELAYS TO WORK

Farrow & Pole Ltd will not be held liable for any costs incurred as a result of delays due to unforeseen circumstances. (e.g. major structural complications - planning permission delays resulting in work having to stop)

11. SUB-CONTRACTORS

In the event that sub-contractors are required, each sub-contractor will be responsible for their own liability.  Where Farrow & Pole Ltd may directly employ or sub contract labour to work on site any liabilities will be recovered by Farrow & Pole Ltd.

Where a project manager / architect employed by the client has introduced a sub-contractor(s) the client will be responsible to recover liabilities from their own sub contractor(s).

12. INSURANCE

Public Liability and Employers’ Liability: Farrow & Pole Ltd has Public Liability Insurance and Employers’ Liability to the sum of £5,000,000.  

13. PAYMENTS

Farrow & Pole Ltd will provide a payment plan upon the contract being agreed. This will include a deposit (a deposit will be calculated based on the materials required to commence the works – typically 5%)

Staged payments and an end payment upon completion of works. Deposits are non-refundable and allow Farrow & Pole Ltd to book work in and agree a formal start date for works and purchase materials.

14. INVOICES

Invoices will be sent out prior to the relevant payment date and each invoice will serve as a receipt for payment. Payments can be made by cash, cheque or bank transfer. All invoices include our bank details for bank transfers. Failure to comply with the payment plan may result in an interruption or the works and extend completion date. Missed payments with no explanation may result in early termination of the contract.

15. DATA PROTECTION ACT 1988

Client information will be kept in accordance with the Data Protection Act 1988.

16. GUARANTEES

Farrow & Pole Ltd offer a 12 month guarantee on any works carried out regarding installation and or repairs with new materials. Guarantees on materials are in accordance with manufacturer’s warranty periods. A 6 months guarantee is offered on plastering work.

Guarantee Exceptions:

Decorations are signed off on completion and not covered by guarantee. Decorations affected by plasterwork within the 4 month guarantee are not covered THEREFORE decorations should ideally be carried after 4 months allowing the plaster to settle.

17. UNFORSEEN DAMAGE

Farrow & Pole Ltd shall not be liable for unforeseen structural damage which includes rotten or perished materials undetected at the time of contract. Whereby any original materials / equipment (e.g., radiators / boilers) need to be removed Farrow & Pole Ltd shall not be liable for their effectiveness once they are replaced. In some cases, the original materials / equipment will not be adequate for reinstallation.    

18. DAMAGES

Farrow & Pole Ltd will take every care and use protective equipment to ensure no damage to client belongings. Our basic care includes the use of dust sheets and plastic sheets as protection. If superior protection is required this shall be discussed with the client and may be subject to additional costs. Responsibility for protection of fabrics is the sole responsibility of the client. Clients should remove any expensive, fragile or sentimental items before work commences. If we are required to move furniture in order to complete our work we will not be held responsible for any breakages or damages that may occur. We advise clients to remove all valuables and expensive items for the duration of the works, as we cannot be held liable for any theft or loss.

19. DISCOUNTS AND RETENTIONS

Prices are based on the understanding that no unauthorised retentions are held. No Main Contractor or Sub Contractor discounts are given. Farrow & Pole Ltd takes pictures of the progress of our projects. We reserve the right to use these pictures on our website and online for marketing purposes. Please email us prior to the start of your work if you are not happy for us to do so.
